Rushmer v Polsue & Alfieri Limited [1906] Ch D 234 A Court of Appeal decision on nuisance. The case affirmed the position that nuisance is difference from negligence in that it does not require carelessness, Cozens-Hardy LJ said the nuisance that is the noise from the steam hammer cannot be negligected on the mere basis that it was the latest and least loud model.
